AN EVESHAM man was fined and given a restraining order after indecently exposing himself to someone who had offered him a lift.
Daniel Smith, 24, of Nuthurst, School Lane, Middle Littleton, pleaded guilty to intentionally exposing himself causing someone alarm or distress, at Worcester Magistrates Court on Friday, February 5.
Magistrates were told by John Cardiff, prosecuting, that the victim had offered to give him a lift home on December 18.
After dropping off a friend, the court heard the victim was on the way to dropping off Smith when she suddenly felt a brushing sensation to her left side.
Mr Cardiff said the victim then saw Smith had his trousers down, and was exposing his private parts, while carrying out an indecent act.
The victim, who said she was shocked and upset, then stopped the car and asked Smith to leave her alone.
He left but Smith later sent messages to the victim, asking her not to tell anyone.
Mr Cardiff said: "The incident lasted five minutes.
"I suggest a restraining order, bearing in mind what went on."
Belinda Ariss, defending, said Smith was a man of good character and as a result of the incident he had resigned from his job, and was now working in a cafe.
She said Smith "had an urge" in the car, and was extremely sorry for what happened and for frightening the victim.
Magistrates issued Smith with a two year restraining order, which means he cannot contact the victim directly or indirectly through a third party during this period.
Smith was given a fine of £160, and ordered to pay a criminal court charge of £160, and a victim surcharge of £60.
He was also given a community order, being ordered to attend 36 sessions of a rehabilitation programme, and was placed on the sexual offenders register, which he must sign for five years.
